Privacy Policy

PRIVACY POLICY

The Personal Data Protection Act 2010 (“the Act”) was introduced by the Government of Malaysia to regulate the processing of personal data in respect of commercial transactions. The Act, which generally applies to all companies and firms that are established in Malaysia, requires us to inform you of your rights in respect of your personal data that is being processed (or that is to be collected and further processed by us) and to also notify you of, among others, the purposes for the data processing. Nathan Rekacipta Studio (PG 0462474-U) (“NARS Branding”, “we”, “us” or “our” and operating as “Nathan Rekacipta Studio”) is committed to the protection of your personal data. This Privacy Notice explains how we collects and processes your personal data in accordance with the Act.

 

1. CONSENT
(i) Your personal data and other information that identifies you as an individual (such as name, postal address, e-mail address and telephone number) including sensitive personal data as defined in the Act (collectively, “Personal Data”) which you provide or have provided to us, including any additional information which you may subsequently provide, for the access, use or purchase of products and/or services advertised, featured, listed or sold by us whether or not on our home shopping platforms may be processed and used by us.

 

(ii) In order to process and use your Personal Data, your consent is required. If you do not consent to the processing of your Personal Data, we may not be able to process your Personal Data for any of the Purposes defined herein and/or we will not be able to process your access, use or purchase of products and/or services advertised, featured, listed or sold by us whether or not on the Home Shopping Platform and/or approve your application to be a registered customer of Nathan Rekacipta Studio. However, where you have provided your Personal Data to us, you shall be deemed to have consented to provide your Personal Data to us.

 

(iii) Where a copy of this Privacy Notice is dispatched or notified to you, if we do not hear from you within fourteen (14) days from the date of dispatch or notification of this Privacy Notice to you, we shall presume that you have approved and consented for us to collect, handle and process your Personal Data in accordance with and in the manner as set out in this Privacy Notice, including for us to contact you for purposes of marketing our products and services. However, you may at any point choose to limit or withdraw your consent to our processing of your Personal Data at any time by contacting our call centre whose contact details are as set out below.

 

(iv) Your consent that is given pursuant to this Privacy Notice is additional to and does not supersede any other consent that you had provided to us with regards to processing of your Personal Data.

 

2. NOTICE AND CHOICE
Your Personal Data may be used and processed by us for the following purposes (collectively “Purposes”):

    1. to provide and maintain our Service;
    2. to notify you about changes to our Service;
    3. to allow you to participate in interactive features of our Service when you choose to do so;
    4. to provide customer support;
    5. to gather analysis or valuable information so that we can improve our Service;
    6. to monitor the usage of our Service;
    7. to detect, prevent and address technical issues;
    8. to fulfil any other purpose for which you provide it;
    9. to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;

    11. to provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information;

3. RETENTION OF DATA

(i) We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

(ii) We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

 

4. DISCLOSURE AND TRANSFER

  1. We may disclose personal information that we collect, or you provide:
  2. Disclosure for Law Enforcement.
  3. Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities.
  4. Business Transaction.

 

If we or our subsidiaries are involved in a merger, acquisition or asset sale, your Personal Data may be transferred.

Other cases. We may disclose your information also:

    1. to our subsidiaries and affiliates;
    2. to contractors, service providers, and other third parties we use to support our business;
    3.  to fulfil the purpose for which you provide it;
    4. for the purpose of including your company’s logo on our website;
    5. for any other purpose disclosed by us when you provide the information;
    6. with your consent in any other cases;
    7. if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others.

Your Personal Data may also be transferred to locations outside Malaysia and stored in any server located in Malaysia or outside Malaysia, for any of the Purposes as stated in this Privacy Notice.

 

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Nathan Rekacipta Studio will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.

 

5. SECURITY
We respect your privacy and take seriously the trust you place in us, and we follow strict guidelines for protecting the security of your Personal Data. We utilize appropriate policies and procedures to safeguard the Personal Data collected, to maintain data accuracy, to ensure appropriate use of the Personal Data and to prevent unauthorized access or disclosure of the same.

 

6. INTEGRITY
We will take reasonable efforts to ensure that your Personal Data is accurate and complete, if your Personal Data is likely to be used by us to make a decision that affects you, or disclosed to another organization. However, this means that you must also update us of any changes in your Personal Data that you had initially provided us with. We will not be responsible for relying on inaccurate or incomplete Personal Data arising from you not updating us of any changes in your Personal Data that you had initially provided us with.

 

7. ACCESS, CORRECTIONS, INQUIRIES, COMPLAINTS

  1. As accorded by the Act, you have the right to request access and correction to the Personal Data which we hold about you. In general, and subject to certain exemptions, you are entitled to request access to your Personal Data, including for copies of the same, for which we may impose upon you the payment of a prescribed fee.
  2. You may at any time hereafter make inquiries, complaints and request for access to, or correction of, your Personal Data or limit the processing of your Personal Data by via registered post or email to the address as set out below.

  1. You may limit the processing of your Personal Data in the manner as follows:

In relation to any advertising and marketing activities which Nathan Rekacipta Studio may carry out in future, you may exercise your opt-out rights by requesting De Nathan Rekacipta Studio  by written notice (in accordance with the following paragraph) not to process your Personal Data for any of the following:

      1. advertising or marketing via phone any product or service of Nathan Rekacipta Studio or those of our related corporations and/or our business partners;
      2. sending to you via post any advertising or marketing material relating to any product or service of Nathan Rekacipta Studio or those of our related corporations and/or our business partners;
      3. sending to you via email or SMS any advertising or marketing material relating to any product or service of Nathan Rekacipta Studio or those of our related corporations and/or our business partners; or
      4. communicating to you by whatever means any advertising or marketing material of Nathan Rekacipta Studio or those of our related corporations and/or our business partners.

 

8. AMENDMENTS AND UPDATES ON PRIVACY NOTICE

  1. As part of our efforts to ensure that we properly manage, protect and process your Personal Data, we may/will be reviewing our policies, procedures and processes from time to time.
  2. This Privacy Notice may be amended at any time from time to time. Any amendment to this Privacy Notice shall be published or posted on the shopping platform and/or communicated to you by such means as we deem fit. Your continued usage of any of our products and/or services or on the shopping platform shall be deemed to be your agreement to the said amendment of this Privacy Notice.
